Laparoscopic Injuries

Errors in Laparoscopic Surgery in New Jersey

Protecting victims throughout the state since 1950

Learning that you require laparoscopic surgery, rather than a more invasive procedure, may at first bring a sigh of relief. Many of these operations are performed on an outpatient basis and result in quicker recovery time, reduced pain and less noticeable scarring. However, you still face substantial risks of serious injury and disability if your surgeons act carelessly. Established in 1950, Gelman Gelman Wiskow & McCarthy LLC helps you recover from the negligent doctors and healthcare facility responsible for your injuries.

Understanding the risks of laparoscopic surgery

Laparoscopic surgery is a minimally invasive procedure used to treat a number of medical conditions. The surgeon makes small incisions to insert a video camera and tiny instruments. The camera transmits images of the surgical site onto a monitor, which the surgeon views to perform the operation. In essence, the camera acts as the surgeon’s eyes.

Because you are not cut open, a successfully performed laparoscopic surgery minimizes the risks of hemorrhaging, infection, nerve damage and scar tissue. The procedure also allows the surgeon to take more precise and intricate actions because the screen enlarges the image of minute organs, nerves and blood vessels. Laparoscopic surgery is often used to perform:

  • Ovarian cyst or fibroid excision
  • Hysterectomy
  • Tissue-sample collection for biopsy
  • Hernia repair
  • Spleen or gallbladder removal
  • Colon and stomach surgery

Common laparoscopic surgery errors

Although less risky than open surgery, laparoscopic procedures present many of the same risks of mistakes as traditional methods — such as an operation on the wrong site or side of the body, infections resulting from using unsterilized equipment, administration of insufficient or excessive anesthesia and inadequate assessment of patient risks. In addition, doctors performing laparoscopic surgery can cause irreparable damage by:

  • Choosing an inappropriate type of trocar
  • Cutting nerves or blood vessels
  • Piercing organs with surgical instruments
  • Using defective surgical tools
  • Implementing inadequate special procedures for very thin or obese patients
  • Conducting an outpatient procedure in a clinic ill-equipped to handle emergency situations

$800,000.00 settlement in less than nine (9) months!
In September of 2025, Phil Wiskow settled a legal malpractice case, resulting from a botched personal injury case, for $800,000.00. Most significantly, Mr. Wiskow settled the case less than nine (9) months after the client hired him. Since the client settled his botched case for over $200,000.00, the full amount of the client's recovery exceeded one million dollars.
Settled his 60 year old client’s motorcycle accident case for $1,700,000.00
In the Spring of 2017, Phil Wiskow settled his 60 year old client’s motorcycle accident case for $1,700,000.00. Frankly, the case would have settled for more money but the most culpable party only had a $300,000.00 liability insurance policy. The firm’s client, who was already disabled and receiving social security benefits at the time of his accident, sustained multiple lower leg fractures–which ultimately resulted in numerous surgeries and an above the knee amputation–when a delivery van blindly backed out of a loading dock and pinned his leg against his bike. The majority of the client’s settlement money was paid by the owner of a tractor-trailer and the lessee of the loading dock whose dangerous loading and unloading procedures blocked the van driver’s view of the motorcycle and the firm’s client’s view of the van.
VERDICTS & SETTLEMENTS
  • In the Spring of 2020, Phil Wiskow settled a motor vehicle/motorcycle accident case for the Defendant’s 1.3M policy limit. The terms of the settlement are confidential.
