Why Do Work Injuries Go Unreported

According to several studies, most work injuriesAccording to several studies, most work injuries aren’t reported to OSHA as required, and many aren’t even reported to management. This OSHA survey indicates that most private companies could not confirm that their OSHA logs are maintained at all. Why would this be? Let’s take a look at a few main causes.

Self-Diagnosing of Injuries

Many injuries don’t immediately show symptoms or seem serious. For example, soft tissue injuries and traumatic brain injuries may have delayed symptoms that aren’t clear until days or weeks after they occur. Workers should not assume an injury isn’t serious enough to seek medical attention, report the incident, and file a workers’ compensation claim.

Fear of Management Disapproval

One common reason why work injuries go unreported is fear of disapproval from management. Workers may fear being disfavored at work, such as being given a less-desirable schedule or shift, being passed over for a raise or promotion, being moved to a lesser position, or even losing their job. If you think this may have happened to you, contact a workers comp attorney as soon as possible.

Blaming Themselves

Many New Jersey workers fear that they can’t file a workers’ compensation claim if they’re responsible for the accident that caused their workplace injury. However, the workers’ compensation system in New Jersey has a no-fault stipulation, so it doesn’t matter whose fault the accident was. If a worker was hurt during the scope of their employment, they are eligible to file a workers’ comp claim.

Unclear Reporting Process

While employers have a duty to educate their workers on how to report workplace injuries, it’s a sad fact that many employees in New Jersey are not clear on how the process is supposed to work. They might not know how to properly submit an injury report, or which injuries need to be reported. While some employers have instituted incentive programs that reward employees and supervisors for reducing workplace injury rates, some employers intentionally do not educate their workers about the reporting process, in order to avoid financial consequences.

$800,000.00 settlement in less than nine (9) months!
In September of 2025, Phil Wiskow settled a legal malpractice case, resulting from a botched personal injury case, for $800,000.00. Most significantly, Mr. Wiskow settled the case less than nine (9) months after the client hired him. Since the client settled his botched case for over $200,000.00, the full amount of the client's recovery exceeded one million dollars.
Settled his 60 year old client’s motorcycle accident case for $1,700,000.00
In the Spring of 2017, Phil Wiskow settled his 60 year old client’s motorcycle accident case for $1,700,000.00. Frankly, the case would have settled for more money but the most culpable party only had a $300,000.00 liability insurance policy. The firm’s client, who was already disabled and receiving social security benefits at the time of his accident, sustained multiple lower leg fractures–which ultimately resulted in numerous surgeries and an above the knee amputation–when a delivery van blindly backed out of a loading dock and pinned his leg against his bike. The majority of the client’s settlement money was paid by the owner of a tractor-trailer and the lessee of the loading dock whose dangerous loading and unloading procedures blocked the van driver’s view of the motorcycle and the firm’s client’s view of the van.
