The Different Types of Workers’ Comp Claims and How to File Them

Workers Compensation Lawyers in New Jersey

injured at workWorkers’ compensation is a system in place to help employees who have been injured on the job receive the medical treatment and financial support they need to recover and get back to work. If you have been the victim of a work-related injury, you may be wondering what types of workers’ comp claims are available to you, and how to go about filing them. Our New Jersey workers’ compensation lawyers at Gelman Gelman Wiskow & McCarthy LLC explain the various types of workers’ comp claims and how clients can go about filing them.

Workers’ Comp Claims for Medical Care or Lost Wages

Many workers’ compensation cases involve personal injury and will require some form of medical attention. Whether you need to see your doctor for a check-up, undergo surgery, or receive physical therapy, your employer’s workers’ compensation insurance should cover the cost of your medical care. In order to get your medical bills paid, you will need to file a claim with the insurer and provide documentation of your injuries and treatment.

If you are injured on the job and are unable to work, you may be entitled to workers’ compensation benefits to cover your lost wages. In order to receive these benefits, you will need to file a claim with your employer’s workers’ compensation insurer.

Workers’ Comp Claims for Temporary Total Disability (TTD)

If you are injured on the job and your doctor determines that you cannot return to work, even on a part-time or light duty basis, you may be eligible for temporary total disability (TTD) benefits. TTD benefits provide workers with a portion of their lost wages while they are unable to work. In order to receive TTD benefits, you will need to file a claim with your employer’s workers’ compensation insurer. You must prove that your injury was the result of a job-related incident.

Workers’ Comp Claims for Permanent Total Disability (PTD)

If you are injured on the job and your doctor determines that you will never be able to return to work, you may be eligible for permanent total disability (PTD) benefits. PTD benefits provide workers with a portion of their lost wages for the rest of their life. PTD benefits are often given alongside Social Security Disability benefits. In order to receive PTD benefits, you will need to file a claim with your employer’s workers’ compensation insurer. You must prove that your injury was the result of a job-related incident and that it has left you permanently disabled.

$800,000.00 settlement in less than nine (9) months!
In September of 2025, Phil Wiskow settled a legal malpractice case, resulting from a botched personal injury case, for $800,000.00. Most significantly, Mr. Wiskow settled the case less than nine (9) months after the client hired him. Since the client settled his botched case for over $200,000.00, the full amount of the client's recovery exceeded one million dollars.
Settled his 60 year old client’s motorcycle accident case for $1,700,000.00
In the Spring of 2017, Phil Wiskow settled his 60 year old client’s motorcycle accident case for $1,700,000.00. Frankly, the case would have settled for more money but the most culpable party only had a $300,000.00 liability insurance policy. The firm’s client, who was already disabled and receiving social security benefits at the time of his accident, sustained multiple lower leg fractures–which ultimately resulted in numerous surgeries and an above the knee amputation–when a delivery van blindly backed out of a loading dock and pinned his leg against his bike. The majority of the client’s settlement money was paid by the owner of a tractor-trailer and the lessee of the loading dock whose dangerous loading and unloading procedures blocked the van driver’s view of the motorcycle and the firm’s client’s view of the van.
VERDICTS & SETTLEMENTS
  • In the Spring of 2020, Phil Wiskow settled a motor vehicle/motorcycle accident case for the Defendant’s 1.3M policy limit. The terms of the settlement are confidential.
